GoDaddy – Användarvillkor för AI

1. Översikt

Dessa användarvillkor (”AI-användarvillkor”) reglerar din användning av alla tjänster som består av AI-produkter, funktioner, bots, agenter, tjänster och/eller verktyg (”AI-tjänster”) som erbjuds av GoDaddy.com, LLC eller dess dotterbolag (”GoDaddy”). Dessutom omfattas din användning av AI-tjänster avGoDaddys Allmänna användningsvillkor, Globalt integritetsmeddelande, Tillägg om databehandling och alla tillämpliga produktspecifika villkor och villkor för den webbplats genom vilken du använder våra AI-tjänster (tillsammans med användarvillkor för AI, ”Avtalet”). Specifika termer som används men inte definieras i dessa Användarvillkor för AI ska ha den innebörd som tillskrivs dem på annan plats i Avtalet.

2. Innehåll i allmänhet

Du kan lämna indata till AI-tjänsterna ("indata") och ta emot utdata från AI-tjänsterna baserat på indata ("utdata"). Indata omfattar utan begränsning all feedback, instruktioner, information eller uppmaningar som du tillhandahåller som en del av AI-tjänsterna. Indata och utdata är tillsammans "innehåll". Du är ansvarig för allt innehåll, inklusive att säkerställa att det inte bryter mot någon tillämplig lag eller dessa AI-användarvillkor eller andra villkor i avtalet eller kränker någon tredje parts immateriella rättigheter, publicitet, integritet eller andra äganderättigheter.
GoDaddy äger exklusivt alla rättigheter, äganderätter och intressen i och till AI-tjänsterna och andra tjänster (enligt definitionen i de allmänna användningsvillkoren) och ingenting i dessa AI-användarvillkor ska anses ge dig några äganderättigheter till AI-tjänsterna.
Mellan dig och GoDaddy, och i den utsträckning som tillämplig lag tillåter, behåller du (a) dina äganderättigheter till indata och (b) äger utdata. I den utsträckning som tillämplig lag tillåter överlåter vi härmed alla våra rättigheter, äganderätter och intressen, om sådana finns, i och till utdata till dig.
Vi kan använda innehåll för att tillhandahålla, underhålla, utveckla och förbättra våra tjänster, följa tillämplig lag, genomdriva våra villkor och policyer, marknadsföra och annonsera våra tjänster samt hålla våra tjänster säkra. 
Du intygar och garanterar att du antingen helt och hållet äger eller har alla nödvändiga rättigheter, licenser, samtycken, tillstånd och behörigheter för allt material som används som indata.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. Uppsägning och avstängning

Vi förbehåller oss rätten att stänga av eller avsluta din åtkomst till våra AI-tjänster eller radera ditt konto enligt eget gottfinnande.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. Friskrivningar

DU BEKRÄFTAR OCH SAMTYCKER SPECIFIKT TILL ATT UTDATA FRÅN AI-TJÄNSTEN INTE HAR GRANSKATS AVSEENDE EXAKTHET, PARTISKHET, FÖRKLARINGSBARHET ELLER IMMATERIELLA RÄTTIGHETER. GoDaddy LÄMNAR INGA UTFÄSTELSER, ANSVARSFÖRBINDELSER ELLER GARANTIER AVSEENDE AI-TJÄNSTERNAS EXAKTHET, TILLFÖRLITLIGHET ELLER FELFRIA PRESTANDA, INKLUSIVE (UTAN BEGRÄNSNING) HURUVIDA UTDATA KAN GÖRA INTRÅNG I, TILLSKANSA SIG ELLER BRYTA MOT EN TREDJE PARTS IMMATERIELLA RÄTTIGHETER.

DU ACCEPTERAR OCH SAMTYCKER TILL ATT ALL ANVÄNDNING AV UTDATA FRÅN VÅR AI-TJÄNST SKER PÅ EGEN RISK OCH ATT DU INTE KOMMER ATT FÖRLITA DIG PÅ UTDATA SOM EN ENDA KÄLLA TILL SANNING ELLER FAKTAINFORMATION, ELLER SOM EN ERSÄTTNING FÖR PROFESSIONELL RÅDGIVNING.

DU BÖR SÖKA OBEROENDE PROFESSIONELL RÅDGIVNING INNAN DU FÖRLITAR DIG PÅ UTDATA SOM GENERERATS AV AI-TJÄNSTERNA.

10. Begränsning av ansvar

UNDER INGA OMSTÄNDIGHETER SKA GoDaddy, DESS TJÄNSTEMÄN, CHEFER, ANSTÄLLDA, OMBUD ELLER UTOMSTÅENDE TJÄNSTELEVERANTÖRER HÅLLAS ANSVARIGA GENTEMOT DIG ELLER EN ANNAN PERSON ELLER ENHET FÖR DIREKTA, INDIREKTA, TILLFÄLLIGA, SÄRSKILDA, STRAFFRÄTTSLIGA ELLER FÖLJDSKADOR AV NÅGOT SLAG, INKLUSIVE DE SOM KAN UPPSTÅ FRÅN UTDATA SOM SKAPAS MED AI-TJÄNSTERNA.

DÄRUTÖVER BEKRÄFTAR DU SPECIFIKT OCH SAMTYCKER TILL ATT GoDaddyS TOTALA SAMMANLAGDA SKULD KOPPLAD TILL AI-TJÄNSTERNA ELLER NGON UTDATA, UNDER INGA OMSTÄNDIGHETER, SKA ÖVERSTIGA 10 000 $ USA- DOLLAR.

OVANSTÅENDE ANSVARSBEGRÄNSNING SKA GÄLLA I DEN UTSTRÄCKNING TILLÄMPLIG LAG SÅ TILLÅTER OCH SKA VARA FORTSATT GILTIG EFTER UPPHÖRANDE ELLER UPPSÄGNING AV DETTA AVTAL ELLER DIN ANVÄNDNING AV DENNA WEBBPLATS, AI-TJÄNSTERNA ELLER ANDRA TJÄNSTER SOM ÅTERFINNS PÅ DENNA WEBBPLATS.

Översatta versioner av juridiska avtal och policyer tillhandahålls endast som en tjänst för att underlätta läsning och förståelse av de engelska versionerna. Syftet med att tillhandahålla översättningar av juridiska avtal och policyer är inte att skapa rättsligt bindande avtal eller att ersätta den rättsliga giltigheten för de engelska versionerna. Vid eventuella tvister eller konflikter reglerar de engelska versionerna av våra juridiska avtal och policyer vår relation och de har företräde framför villkor på andra språk.
